1. General Provisions & Acceptance

These Terms of Service (hereinafter the "Terms") govern your ("User", "you", or "your") access to and use of the DS Manager Pro application and related subscription services (hereinafter the "Service"), provided by EZV spol. s r.o. (hereinafter the "Service Provider", "we", "us", or "our"), a company registered in Slovakia.

The Service is available for download on the Apple App Store for compatible iOS, iPadOS, macOS, and watchOS devices. By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

2. Subscriptions & Apple In-App Purchases

Certain features and capabilities of DS Manager Pro are billed on a recurring subscription basis ("Subscription(s)") or available via one-time In-App Purchase. All subscription payments and renewals are processed securely through Apple In-App Purchases (StoreKit).

Payment will be charged directly to your Apple ID account upon confirmation of purchase. Subscriptions are billed in advance on a recurring periodic basis (such as monthly or annually), depending on the subscription tier you select.

Subscriptions automatically renew under the exact same conditions unless auto-renewal is turned off at least 24 hours before the end of the then-current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing cycle at the applicable renewal rate.

You can manage your subscriptions and disable auto-renewal at any time by navigating to your Apple ID Account Settings on your Apple device (Settings > [Your Name] > Subscriptions).

3. Free Trial Policy

We may, at our sole discretion, offer a Subscription with a free trial period for a limited time ("Free Trial"). You may be required to confirm the subscription via your Apple ID to activate the Free Trial.

You will not be charged during the Free Trial period. On the final day of the Free Trial, your subscription will automatically renew into a paid Subscription and your Apple ID will be charged, unless you cancel the subscription in your Apple ID Account Settings at least 24 hours before the Free Trial period expires.

Any unused portion of a Free Trial period, if offered, will be forfeited when purchasing a Subscription, where applicable. We reserve the right to modify the terms and conditions of, or cancel, any Free Trial offer at any time without prior notice.

4. Fee & Price Changes

EZV spol. s r.o. reserves the right, in its sole discretion and at any time, to modify Subscription fees. Any Subscription fee modification will become effective at the end of the then-current billing cycle.

In accordance with Apple App Store policies, you will receive reasonable advance notice from Apple regarding any price adjustment, giving you the opportunity to review or cancel your Subscription before the new rate takes effect. Your continued use of the Service after the price adjustment takes effect constitutes your agreement to pay the modified Subscription fee.

5. Cancellation & Refunds

You may cancel your Subscription renewal at any time through your Apple ID Account Settings. Upon cancellation, your subscription access remains active until the expiration of the prepaid billing period, after which it will not renew.

All billing, invoicing, payment processing, and refund determinations are handled exclusively by Apple Inc. in accordance with the Apple Media Services Terms and Conditions. EZV spol. s r.o. does not collect, store, or process your credit card information and does not possess the technical or contractual authority to issue direct refunds.

Except when required by applicable consumer law, paid Subscription fees are non-refundable. To request a refund from Apple, please visit Apple's official reporting portal at reportaproblem.apple.com.

6. Intellectual Property & App License

The Service and its original code, visual design, user interfaces, feature logic, trademarks, and documentation are and will remain the exclusive intellectual property of EZV spol. s r.o. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DS Manager Pro on compatible Apple devices owned or controlled by you, solely for your personal or internal business use. You may not reverse engineer, decompile, disassemble, or extract source code from the application.

7. Direct Connection & User Security Responsibilities

DS Manager Pro is engineered to communicate directly between your Apple device and your server, network storage, or container endpoints over local Wi-Fi, LAN, encrypted VPN, or direct HTTPS/TLS connections. EZV spol. s r.o. operates no intermediary cloud servers, proxies, or relays for your server traffic.

You acknowledge and agree that you are solely responsible for: (a) maintaining the confidentiality and hardware-backed Keychain security of your server credentials and API tokens; (b) properly configuring your server firewall rules, open ports, and secure SSL/TLS certificates; and (c) maintaining appropriate data backups. EZV spol. s r.o. assumes no liability for unauthorized access, data loss, or server downtime resulting from your network or server configuration.

8. Third-Party Services & Trademark Notice

The Service may interact with or reference third-party hardware, operating systems, and platforms, including Synology DSM, QNAP QTS, TrueNAS, Docker, Portainer, and Apple platforms. Synology®, QNAP®, TrueNAS®, Docker®, and Apple® are trademarks or registered trademarks of their respective owners.

EZV spol. s r.o. is an independent software studio and is NOT affiliated with, sponsored by, or endorsed by Synology Inc., QNAP Systems Inc., iXsystems Inc., Docker Inc., Portainer.io, or Apple Inc. Our Service may also contain links to third-party websites not controlled by us; we assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties ("As Is")

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

EZV spol. s r.o., its subsidiaries, affiliates, and its licensors do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be immediately corrected; (c) the Service is completely free of bugs or harmful components; or (d) the results of using the Service will meet your specific technical or business requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall EZV spol. s r.o., its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data loss, hardware damage, or business interruption, arising out of or in connection with your use of or inability to use the Service.

In no event shall our total aggregate liability exceed the total amount actually paid by you to EZV spol. s r.o. for the Service in the twelve (12) months preceding the event giving rise to liability.

11. Modifications to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable advance notice (e.g. through the application or website updates) prior to any new terms taking effect.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please discontinue using the Service and cancel your Subscription.

12. Governing Law & Contact Information

These Terms shall be governed and construed in accordance with the laws of the Slovak Republic (European Union), without regard to its conflict of law provisions.
